Mississippi pet insurance law

Mississippi regulates pet insurance under Miss. Code Ann. §§ 83-87-1 to 83-87-9, enacted by SB 2228 (2023), effective 1 July 2023.

Key provisions

Pre-existing condition rule
  • Model-Act definition (vet advice, previous treatment, or signs/symptoms before effective date or during waiting period)
  • Covered condition not preexisting at renewal.
Wellness programs
  • Wellness program defined
  • A program meeting the definition of insurance is subject to the insurance code. No Model-Act wellness sales-practice section found in statute text.
Required disclosures
  • Preexisting/hereditary/congenital/chronic exclusions and 'other exclusions may apply' statement
  • Waiting/affiliation periods, deductibles, coinsurance, annual/lifetime limits
  • Claims-history/age/location premium or coverage changes
  • Underwriter if different from brand.
Agent licensing and training
  • Producers licensed in a major line of authority and appointed by a pet insurer may sell
  • Commissioner may set training requirements
  • Substantially similar out-of-state training accepted.
Mississippi's statute is an early, partial version of the model. It does not set waiting-period caps or a free-look period. A separate state insurance department regulation (19 Miss. Admin. Code Pt. 5, Ch. 6) may cover these and is not summarized here. The code section numbers are as listed in the NAIC's state chart.
Not legal advice. This is a summary of the statute as enacted. Read the policy and the law itself, or ask the state insurance department, before relying on it.
